By downloading or using the NightOwl mobile application ("the App"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the service.
2. Eligibility
You must be at least 18 years old to use NightOwl. We do not permit users under 18. By using the app, you represent and warrant that you meet this age requirement.
3. Community Guidelines & Safe Talk
NightOwl is a place for authentic, human connection. To keep it safe, you agree NOT to:
- Harass, bully, or intimidate other users.
- Use hate speech or discriminatory language.
- Share sexually explicit content or engage in solicitation.
- Impersonate any person or entity.
- Record or broadcast conversations without the explicit consent of the other party.
- Spam or promote commercial services.
4. Anonymity and Responsibility
While we provide a platform for anonymous interaction, you are solely responsible for your conduct during calls. You are responsible for any information you choose to share with others (such as your real name or contact info). We strongly advise against sharing sensitive personal details with strangers.
5. The Golden Minute
The "Golden Minute" is a core feature of NightOwl. After the initial 60 seconds, users must mutually agree (via heart sent) to continue the connection or unlock direct messaging. Users who attempt to bypass this system or use it for harassment will be banned.
6. Termination
We reserve the right to suspend or terminate your access to the App at our sole discretion, without notice, for behavior that violates these Terms or our Community Guidelines.
7. Disclaimers
NightOwl is provided "as is" and "as available." We do not guarantee that the service will be uninterrupted or error-free. We are not responsible for the behavior of any user, either online or offline. Use of the service is at your own risk.
8. Limitation of Liability
To the maximum extent permitted by law, NightOwl and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the App.
9. Intellectual Property
All content, features, and functionality of the App (excluding user-generated conversation) are the exclusive property of NightOwl and are protected by international copyright and trademark laws.
10. Governing Law
These Terms are governed by the laws of the jurisdiction in which the developer is based, without regard to its conflict of law provisions.
